1.1 Account Terms and Minimum Age
By registering for or using our service, you agree to these terms. You are responsible for maintaining the security of your account and password. The service cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
You must be at least 16 years old to create an account or otherwise use our service. You must be at least 18 years old to create an Expert profile, create an event, sell tickets, or otherwise transact on our platform. By registering, you confirm that you meet the age requirement that applies to you.
We do not knowingly permit accounts held by anyone below these ages. If we become aware of one, we may suspend or close it and will delete the associated personal data as described in section 2.9.
1.2 Acceptable Use
You may not use our service for any illegal or unauthorised purpose. You must not violate any laws in your jurisdiction (including but not limited to copyright laws). You are responsible for all content posted and activity that occurs under your account.
1.3 Service Modifications
We reserve the right to modify or terminate the service for any reason, without notice at any time. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the service.
1.4 User Content and Licensing
By posting, uploading, or sharing content on our platform (including but not limited to posts, requests, comments, reviews, and other user-generated content), you grant us a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, modify, and distribute such content for the following purposes:
- Operating and improving our service
- Promotional and advertising activities across all media channels (online and offline)
- Marketing materials and case studies
- Third-party promotional partnerships
This licence includes the right to use your username, display name, and company name (if provided) in connection with your content. We will not use your personal contact information (email, phone number, physical address) for promotional purposes without your explicit consent.
You represent and warrant that you own or have the necessary rights to grant this licence for all content you post, and that such content does not violate any third-party rights or applicable laws.
1.5 Intellectual Property
Our service and its original content, features, and functionality are and will remain the exclusive property of our company and its licensors. The service is protected by copyright, trademark, and other laws. You may not use our trademarks or copyrighted material without our express written permission.
We respect intellectual property rights and expect our users to do the same. If you believe that any content on our service infringes your copyright, please contact us with details of the alleged infringement. We will investigate and take appropriate action, including removing infringing content when required by law.
1.6 User Responsibilities and Indemnification
You agree to indemnify, defend, and hold harmless our company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable solicitor fees) arising out of or in any way connected with:
- Your use of our service
- Your violation of these terms
- Your content or any content posted through your account
- Your violation of any rights of another party, including any intellectual property rights
1.7 Dispute Resolution
Any disputes arising from these terms or your use of our service shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be conducted by a single arbitrator and will be limited to the dispute between you and us individually.
You waive any right to participate in a class action lawsuit or class-wide arbitration against us. This arbitration provision shall survive termination of these terms.
1.8 Limitations of Liability
We shall not be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of the service. In no event will our liability exceed the amounts paid by you to us in the three months preceding the event giving rise to the liability.
1.9 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, or government actions.
1.10 Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms will remain in full force and effect.
1.11 Expert Marketplace Disclaimer
Platform Role: Atalist operates as an intermediary platform that connects users with independent service providers ("Experts"). We do not employ, supervise, direct, or control any Expert, nor do we provide any services directly. All Experts are independent contractors operating their own businesses.
Open Marketplace: Anyone can register and be listed as an Expert on our platform, regardless of their professional background, qualifications, or business status. We do not impose restrictions on who can create an Expert profile.
Selling Rules: What may be listed, and the rules every seller follows, are in section 1.17.
No Verification or Endorsement: We do not verify, validate, or endorse the qualifications, credentials, licences, skills, experience, identity, or business registration status of any Expert listed on our platform. We specifically do not verify if Experts are registered as legitimate businesses, hold required licences, or have proper insurance coverage. Expert profiles and information are self-reported and user-generated content. The presence of an Expert on our platform does not constitute our recommendation, endorsement, or guarantee of their services, qualifications, or legitimacy.
User Responsibility for Due Diligence: You are solely responsible for:
- Researching and verifying Expert credentials, licences, insurance, and qualifications
- Ensuring Experts comply with local and national licensing requirements
- Checking references, reviews, and background information independently
- Confirming Expert insurance coverage and bonding where applicable
- Negotiating terms, pricing, and service agreements directly with Experts
- Ensuring compliance with all applicable laws and regulations in your jurisdiction
High-Risk Services Warning: Special caution is advised when engaging Experts for services that may pose health, safety, legal, or financial risks, including but not limited to:
- Medical/Healthcare Services: Verify medical licences, professional indemnity insurance, and credentials through official medical councils
- Legal Services: Confirm admission to the bar and good standing with relevant law societies or bar councils
- Construction/Electrical/Plumbing: Verify contractor licences, permits, bonding, and public liability insurance
- Financial Services: Confirm proper licensing and regulatory compliance with the FCA or relevant authorities
- Childcare Services: Conduct DBS checks and verify childcare registration where required
No Liability for Expert Services: We expressly disclaim all liability for any loss, damage, injury, or harm resulting from:
- Expert services, advice, or recommendations
- Expert negligence, misconduct, or criminal activity
- Property damage or personal injury caused by Experts
- Financial losses or disputes with Experts
- Expert failure to perform or honour agreements
- Expert use of unlicensed, unqualified, or fraudulent practices
Payment and Financial Arrangements: Unless an order is paid on Atalist as described in section 1.12, all financial transactions, payments, and agreements are made directly between you and the Expert, and Atalist does not process those payments. Atalist does not hold funds or guarantee payment disputes. We are not responsible for payment failures, disputes, refunds, or financial losses related to Expert services.
Content Moderation Limitation: Whilst we may perform limited content moderation on profiles and reviews, we do not verify the accuracy of information provided by Experts or users. User reviews and ratings reflect individual experiences and should not be considered as verified assessments of Expert qualifications or service quality.
Assumption of Risk: By using our platform to connect with Experts, you acknowledge and assume all risks associated with engaging independent service providers. You agree that your use of Expert services is at your own risk and discretion.
Regulatory Compliance: You are responsible for ensuring that your engagement with any Expert complies with all applicable local, national, and international laws and regulations, including but not limited to licensing requirements, consumer protection laws, and professional service regulations.
1.12 Payments on Atalist
An Expert who confirms an order request may let the customer pay for it on Atalist instead of arranging payment directly. This section covers only those orders, in addition to section 1.11. For now, this is open only to Experts in the euro area, in euros.
How Payment Works: The customer pays by Stripe Checkout, straight into the Expert's own Stripe account. The Expert is the seller. Atalist never holds the money: it stays in the Expert's Stripe balance until Stripe pays it out. The customer gets Stripe's receipt in the Expert's name. Invoices are the Expert's, and Atalist issues none.
Commission and Fees: Atalist charges the Expert a commission on each payment, which Stripe deducts for Atalist. Refunds made through Atalist return the commission to the Expert in proportion, but refunds the Expert makes directly in their Stripe Dashboard do not. Stripe charges the Expert its own fee as well.
Payouts: Atalist decides when Stripe pays each order out to the Expert. As a rule, this is 30 days after the Expert marks the order shipped, or completed when it does not ship. A payout can come later while Atalist looks into a problem, but never later than Stripe allows.
Refunds: A paid order cancelled before it ships is refunded in full, automatically. After it ships, the Expert or Atalist may refund the customer, in full or in part, from the Expert's Stripe balance.
Expert Obligations: By setting up payments, the Expert agrees to Stripe's services agreement with Stripe during Stripe's onboarding, and agrees that Atalist decides their payouts and may refund customers on their behalf. The Expert keeps enough money in their Stripe balance for refunds, including Stripe's fee on the refunded payment, which Stripe does not return, and tops it up when Atalist asks.
1.13 Subscriptions and In-App Purchases
We offer subscription services for Expert profiles through various payment platforms:
Subscription Details:
- Starter Membership: Monthly subscription providing basic Expert profile features
- Bronze Membership: Monthly subscription providing enhanced Expert profile features
Subscriptions automatically renew monthly until cancelled. Prices are displayed in your local currency at the time of purchase.
Subscription Requirement: Creating an Expert profile requires an active subscription (Starter or Bronze membership), except for free profiles (below). The subscription purchase will be initiated immediately when you submit your expert profile form. Your payment will be processed through your Apple ID (iOS App Store) or Google Play account (Android) upon confirmation.
Free Profiles: Some Expert profiles are free: profiles whose specialities are all marked as free, and profiles offering only local, in-person services in a country where Atalist does not yet charge for Expert profiles. We do not collect payment details for a free profile. Atalist may introduce paid plans for free profiles at any time, in one country or everywhere. You will only pay if you choose a paid plan yourself; if you do not, your profile may be taken offline.
Payment Platforms:
- Web Platform: Subscription payments on our website are processed by Stripe. Stripe handles payment processing, billing, and subscription management.
- iOS App (Apple Devices): Subscription purchases made through the iOS App Store are processed by Apple. Apple manages payment processing, billing, and subscription renewal. To manage your subscription, visit your device's Settings → Apple ID → Subscriptions.
- Android App (Google Play): Subscription purchases made through Google Play are processed by Google. Google manages payment processing, billing, and subscription renewal. To manage your subscription, visit the Google Play app → Menu → Subscriptions.
Subscription cancellations must be made at least 24 hours before the end of the current billing period to avoid renewal. Refund requests for mobile app purchases should be directed to Apple or Google through their respective support channels. For web purchases, please contact our support team.
Terms of Use (EULA):
- iOS App Store: For subscriptions purchased through the iOS App Store, Apple's Standard End User License Agreement (EULA) applies: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
- Google Play: For subscriptions purchased through Google Play, Google Play's Terms of Service apply in addition to these terms.
- Web Platform: These Terms of Service govern all web-based subscriptions.

- Sexually exploits, sexualises, or otherwise endangers a child, or breaches our Child Safety Standards
- Violates these Terms of Service or any applicable policies
- Is illegal, fraudulent, deceptive, or misleading
- Infringes any intellectual property, privacy, or other rights
- Is harmful, abusive, harassing, defamatory, or offensive
- Contains spam, malware, or unauthorised advertising
- Poses a risk to user safety or platform security
- We reasonably believe is inappropriate or harmful to the platform, its users, or third parties
Account Suspension and Termination: Atalist reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or permanently terminate any user account for:
- Violation of these Terms of Service or any applicable policies
- Fraudulent, deceptive, or illegal activity
- Abuse of the platform, other users, or our staff
- Creating multiple accounts or circumventing account restrictions
- Non-payment of fees or chargebacks
- Providing false or misleading information
- Any activity that we reasonably believe harms the platform, its reputation, or its users
- Inactivity for an extended period
Expert Profiles and Listings: For Expert profiles and listings, section 1.17 applies where it differs from this section.
Immediate Action Without Notice: We may take immediate action without prior notice when:
- Required by law, regulation, or legal process
- Necessary to protect user safety or prevent harm
- Necessary to prevent fraud, security threats, or illegal activity
- The account or content poses an imminent risk to the platform or others
Effects of Termination: Upon account termination:
- Your right to access and use the service will immediately cease
- We may delete or retain your content and data as permitted by applicable law
- You remain liable for any obligations incurred before termination
- Paid subscription fees are generally non-refundable upon termination for cause
- Provisions that by their nature should survive termination will remain in effect
No Liability: Atalist shall not be liable to you or any third party for any suspension, restriction, or termination of your account or removal of your content when we act in line with these terms.
Appeals: If you believe your content was removed or your account was terminated in error, you may contact us at support@atalist.com to request a review. We will consider such requests but are under no obligation to restore content or accounts.
1.15 Events and Ticketing
Atalist allows users to create, discover, register for, and attend events organised by other users or experts on the platform. By creating or attending events through our platform, you agree to the following terms in addition to all other terms in this agreement.
Event Creation: Any logged-in user may create an event, either linked to an active expert profile or as an independent user. All events are subject to review and approval by Atalist before they become publicly visible. We reserve the right to reject, remove, or suspend any event at our sole discretion. Creating a free event is free of charge. Independent users creating paid events may be charged a one-time creation fee, payable via Stripe at the time of submission.
Event Review and Approval: All events must pass a mandatory review process before becoming publicly visible. Atalist does not guarantee approval of any event. Approved events may still be removed or suspended if they are later found to violate these terms or applicable laws.
Event Formats: Events may be physical (in-person), online (virtual), or hybrid. The event organiser is solely responsible for securing venues, online meeting platforms, and all logistics related to the event.
Ticket Purchases and Payments: Paid event tickets are purchased through Stripe payment processing on our web platform. Ticket prices are set by the event organiser and displayed in the currency chosen by the organiser. A platform service fee may be added to the ticket price at checkout. All ticket purchases are final upon successful payment unless otherwise required by applicable law. Ticket prices include all applicable fees unless separately disclosed at checkout.
Refund Policy:
- Paid ticket registrations cannot be cancelled or refunded through the platform in the current version. To request a refund, attendees must contact the event organiser directly.
- If an event is cancelled by the organiser, attendees with paid tickets should contact the organiser for refund arrangements. Atalist does not process refunds on behalf of organisers.
- Free event registrations may be cancelled at any time before the event ends.
- Refund disputes should be directed to the event organiser first. If unresolved, contact us at support@atalist.com.
Registration and Waitlists: Events may have limited capacity. When an event reaches full capacity, you may be placed on a waitlist if the organiser has enabled one. Being on a waitlist does not guarantee admission. Some events may require organiser approval before your registration is confirmed.
Tickets and QR Codes: For physical and hybrid events, confirmed registrations receive digital tickets with unique codes and QR codes for check-in purposes. You are responsible for safeguarding your ticket codes. Sharing your ticket code or QR code with others may result in denial of entry. Tickets are non-transferable except through the platform's built-in transfer feature, where available.
Event Visibility: Events may be set as public, unlisted, or private by the organiser. Public events are discoverable in search and listings. Unlisted events are accessible only via direct link. Private events are accessible only to users whose email address has been added to the organiser's invite list.
Mobile App Ticket Purchases: For paid events accessed through the mobile app, ticket purchases are processed on the web platform via Stripe. The mobile app will direct you to the web checkout flow to complete your purchase. This ensures a consistent and secure payment experience across all platforms.
Attendee Conduct: By registering for an event, you agree to comply with any rules or guidelines set by the event organiser, as well as all applicable laws. Atalist is not responsible for your conduct at events or any disputes between attendees and organisers.
No Guarantee of Event Quality: Atalist does not guarantee the quality, safety, accuracy of description, or occurrence of any event listed on the platform. Events are organised by independent users and experts, and Atalist acts solely as an intermediary platform. You attend events at your own risk.
1.16 Event Organiser Terms
By creating an event on Atalist, you agree to the following additional terms as an event organiser:
Organiser Responsibilities: As an event organiser, you are solely responsible for:
- The accuracy and completeness of all event information, including title, description, dates, location, and pricing
- Securing and maintaining the event venue (for physical and hybrid events) and online meeting platform (for online and hybrid events)
- Complying with all applicable local, state, federal, and international laws and regulations, including permits, licences, health and safety requirements, and consumer protection laws
- Managing attendee communications, check-ins, and on-site logistics
- Handling refund requests and attendee disputes directly
- Ensuring the event takes place as described or notifying attendees of any changes or cancellation
Platform Service Fees: Atalist charges a service fee on paid event ticket sales. The fee percentage is displayed during event creation and at attendee checkout. Fees are deducted from the total ticket revenue before payout.
Payouts: Organisers of paid events will receive payouts for ticket revenue after the event has concluded, subject to the following conditions:
- You must provide valid payout details (IBAN, account holder name, and optionally BIC/SWIFT code) through your event management dashboard
- Payouts are processed after a holding period following the event's end date, to allow for dispute resolution and refund processing
- Atalist deducts applicable platform fees and payment processing fees before calculating the net payout amount
- Payouts are sent via bank transfer to the account specified in your payout details
- Atalist reserves the right to hold or delay payouts if there are unresolved disputes, suspected fraud, or violations of these terms
- You are solely responsible for any tax obligations arising from event revenue, including income tax, VAT, or any other applicable taxes in your jurisdiction
Event Cancellation by Organiser: If you cancel an event, you are responsible for notifying all registered attendees and arranging refunds for paid tickets. Atalist may assist with attendee notifications but is not obligated to process refunds on your behalf.
Content Accuracy and Liability: You represent and warrant that all event information you provide is accurate, complete, and not misleading. You agree to indemnify Atalist against any claims arising from your event, including but not limited to personal injury, property damage, financial loss, or any other harm suffered by attendees or third parties in connection with your event.
Intellectual Property: You represent that you have the right to use all content (including images, descriptions, and branding) associated with your event. You grant Atalist the right to display and promote your event on the platform and in marketing materials.
1.17 Selling on Atalist
Who Can Sell: Anyone with an Expert profile can list products and services, as a business or as a private person. Each seller tells Atalist which one applies, and buyers see it before they order. Choose business if you sell regularly or to make money; you are responsible for your choice being true. When you buy from a private seller, EU consumer law does not apply to the purchase.
Atalist Is Not the Seller: Atalist is not a party to any sale made on Atalist. The seller sets the price, describes the product, delivers it, and handles returns, refunds and complaints. Atalist does not check, guarantee or endorse products, sellers or sales, and reviewing a listing does not change this. Payment on Atalist, where the seller offers it, is described in section 1.12.
What May Not Be Listed: Sellers may list products and services only in the categories Atalist offers. The following may never be listed, in any category: adult products and services; tobacco, nicotine and vaping products, and smoking accessories; cannabis, THC and CBD products; firearms, ammunition, firearm accessories, weapons, explosives and fireworks; prescription medicines and prescription medical devices; gift cards, vouchers and other stored value; digital goods and downloads, such as software, e-books, digital media and in-game items; anything delivered online other than a live one-to-one session, such as files, courses or sessions for a group; subscriptions, memberships and anything else charged again automatically (a package paid once, such as ten lessons, is allowed); lotteries, raffles, prize draws and betting; live animals; recalled or unsafe products; and counterfeit or stolen goods, or anything that is illegal where it is offered or delivered. Until Atalist offers a category for them, food and drink, alcohol, whole vehicles and used or second-hand goods may not be listed either. Atalist reviews listings against these rules and may remove any listing at any time.
Business Sellers: If you sell as a business, you follow the laws on selling to consumers. You give buyers your business details and the information the law requires, including their right to withdraw from a purchase made at a distance within 14 days and their legal guarantee, and you respect these rights. Buyers can withdraw from an order with a business seller on the order's page on Atalist. For goods, you give the manufacturer's name, postal address and an email address or website and, if the manufacturer is outside the EU, the same for its EU responsible person, with any warnings and safety information. If you sell goods to customers in the EU, your business must be established in the EU and the goods must be sent from inside the EU. You are responsible for your own taxes.
Customers' Details: Use the details a customer shares with you only to handle their order, and never for marketing without their consent.
How Products Are Ordered: The Store shows the newest products first. When you search, the products that best match your search come first. No one can pay to appear higher.
Reporting a Listing: If you think a listing is illegal or breaks these rules, report it from the product page or through our contact form. We act quickly on reports.
When the Rules Are Broken: We may remove a listing, suspend an Expert profile or close it. We tell the seller why by email, and the seller can ask us to review the decision through our contact form. We close a business seller's profile with 30 days' notice, unless the seller has broken these rules repeatedly or the law requires us to act sooner.
Changes to These Terms: We tell Experts by email about changes to these terms at least 15 days before the changes apply to them.
